Part-time employment is one of the fastest-growing forms of employment in the US today. People are working several part-time jobs at a time, while other people just have one part-time job and spend the rest of their time in school or at home with their families. Part-time employment means that the employer only has to have that employee at their job for 35 hours of less each week. Full-time employment is generally considered between 35 and 40 hours or more each week.

Seasonal employment is also popular. The most popular time for seasonal employment in the US is during the winter holidays like Hanukah and Christmas. Seasonal employees are generally hired in September. They begin in October and finish their employment period in January. They often work full-time (meaning over 35 hours a week) during this time period, but are not considered full-time employees because they are only there for the season.

Race Discrimination: Disparate Impact

Of the two common types of racial discrimination that are found in the workplace, disparate impact is the harder one to describe and even harder to prove. Disparate impact, unlike disparate treatment, is not directly aimed at a particular person or race, nor is it intentional. In fact, it is often a complete accident that disparate impact happens at all, and generally it is the fault of company policies.

One example is using the Jewish race and faith. If a Hasidic Jewish man is hired by a company and is not treated unfairly because of his race, then he is not experiencing disparate treatment. But if the company's policy requires every employee to work one Saturday a month, the Jewish man may experience disparate impact because he cannot work on Saturdays because it is the Sabbath. In this situation, the company may change their policy regarding the necessity of everyone to work one Saturday each month.

This may sound odd, and according to California state law, it is. In fact, California state law requires necessary pregnancy leave of four months or less for the expectant mother. This is considered a "reasonable period of time", and is defined as the time period when the woman is "disabled" and cannot work due to her impending or recent childbirth.

What the Federal Title VII law does support, however, is the necessity of medical leave under the Family and Medical Leave Act. This act requires employers to provide employees with a leave of absence for personal illness or for the illness of an immediate family member. This act also covers pregnant women under Federal law jurisdiction.

Who is not Protected from Workplace Discrimination?

Most people are aware of the protected categories of people who are protected by laws and legal statutes from workplace; people cannot be turned down for a job or fired from a job because of their race, religion, gender, sexual orientation, disability, age or because of pregnancy. However, there are other things that are more specific and often related to these protected categories that are not listed under the protected categories.

For example, an employer does not have to hire someone who is too young for the position, but they cannot overlook a qualified candidate because he or she is over forty. Employers can discriminate against weight problems in potential or current employees provided the condition is not medical. Also, long hair and facial hair are not protected under anti-discrimination laws as long as these things are not worn for religious reasons. Essentially, if something is not explicitly listed under the protected categories, it does not have to be accepted by employers.
